    期货立法应坚持三基本原则      

    中金所总经理朱玉辰在"两会"期间提交了一份议案和四份书面意见

    朱玉辰表示，期货立法应当坚持三个基本原则：

    一是期货立法应当借鉴期货市场规范和发展的经验，充分吸收《期货交易管理条例》的成果。《条例》是中国期货市场发展经验及教训的"固化"，反映了中国期货市场的发展与监管的基本规律，因此对于其中的有益制度设计需在期货立法中予以继承。

    二是参照证券市场的监管经验，尤其是证券市场集中统一的监管体制及相关监管措施。

    三是为将来的期货市场制度创新预留法律空间。期货立法的政策取向应当适应国家宏观经济政策环境变化的需要。期货立法应当充分考虑期货市场中长期发展的需要，规范与发展并重，在强化监管的同时，也强调促进期货市场的稳步发展。要减少不必要的行政管制，适度鼓励市场创新，为进一步发挥市场功能，服务于国民经济建设创造良好的法制环境。

    在具体立法的技术层面，《期货法》立法中应保持规范条文的原则性与灵活性，尽量避免不要对期货市场的发展造成法律上的障碍。（东方早报/俞立严）
