缴纳住房公积金相当强制保险吗

    我是北京市户口，在中外合作的公司上班，一直都没缴存过住房公积金。现在听说住房公积金是强制保险，想确认到底是不是强制保险？如果是的话，我有权向公司提出要求吗？

    王先声同志：您的问题也是很多读者共同关心的问题，为此，我们咨询了北京住房公积金管理中心，他们的答复是：

    1.公积金不是一种社会保险。因此不能用“强制险”的概念来定义。

    2.《住房公积金管理条例》中的第二条对住房公积金有明确的定义：“本条例所称住房公积金，是指国家机关、国有企业、城镇集体企业、外商投资企业、城镇私营企业及其他城镇企业、事业单位、民办非企业单位、社会团体及其在职职工缴存的长期住房储金。”住房公积金制度就是自1999年《住房公积金管理条例》颁布后开始强制执行。目前对于符合《北京住房公积金缴存管理办法》规定的单位及在职职工都应当建立并缴存住房公积金。

    3.《住房公积金管理条例》以及《北京住房公积金管理条例》都说明，相应的单位有为职工缴存住房公积金的义务。如果单位没有为职工缴存公积金，没有为职工代扣、代缴住房公积金，职工的住房公积金权益就受到了侵害。遇到这种情况，职工可以向单位主张自己的权益。
