擅自拉黑活 私家车被抢保险公司不赔

    “奇瑞”司机李某将车借给亲戚，不料，亲戚在拉黑活中被乘客将车抢走。昨天，市一中院做出判决称，因该车主擅自搭客并收取费用的行为属于“变更车辆用途”，保险公司依法也可以不赔偿该车的损失。

    2006年5月7日下午，李某的亲戚武先生驾驶该车去昌平联系业务。途中，为了能将汽油费节省出来，武先生捎带了一位陌生人，并与对方约定了150元的车费。没想到，该陌生人将车抢走。

    武某报案的同时，也通知了投保的太平洋财保北京分公司。此后，车辆一直未能找到，抢匪至今也未被抓获。李某提出理赔遭拒后，将保险公司诉至法院，要求他们赔付7.4万余元及延期付款利息等。

    一中院认为，保险合同中明确规定，被保险人私自将保险车辆转卖、转让、赠送他人、变更用途的，保险人有权拒绝赔偿。李某将车辆借予他人使用，且在使用过程中擅自搭载乘客并收取费用，其行为实际上已经改变了私人用车的性质及车辆的用途，并最终导致该车辆被抢，李某的行为违反了保险合同的约定，属于太保北京分公司的免责范围。
