交强险诉讼申请被北京第一中级人民法院驳回

    北京德润律师事务所律师刘家辉提出对“交强险进行听证”的诉讼请求已经被第一中级人民法院驳回，律师代理的近千名车主希望交强险走上法律诉讼程序的愿望至此夭折。

    上周五上午，刘家辉收到了北京市第一中级人民法院的“退件通知”，该通知全文如下：“刘家辉，你于2007年6月11日向我院提交了起诉材料，经审查，你提交的起诉材料，缺少下列条件的第11项，不符合立案要求，故将材料退还给你。”法院所指的第11项是：属于法院受案范围。也就是说，法院退回刘家辉诉讼申请的理由是：法院认为本案不属于受案的范围。

    今年6月11日，刘家辉一纸交强险诉讼状提交到第一中级人民法院。当时，她代理156位机动车投保人依据行政许可法有关规定向保监会提出交强险听证申请。她要求法院撤销保监会做出的(2007)112号《关于机动车交通事故责任强制保险行政许可听证申请的复函》，并判决保监会重新做出交强险行政许可听证答复。

    没想到经过一个多月的等待，却未能成功。刘家辉表示，上述结果可能令授权她代理的车主有些失望。谈到法院不受理此案的理由，刘家辉认为：“法院的立案标准和专家学者及我个人对立案标准的判断是有所差异的。”

    在诉讼之路受阻后，刘家辉已经把行政复议申请转给保监会，希望能够尽快得到保监会的答复。
