逆行宝来撞上奔驰 奔驰贬值费究竟该由谁来埋单?

    2006年9月11日，一奔驰车正常行驶时，被一逆行宝来车撞个正着，两车都有受损。宝来车所投保的保险公司要求奔驰车必须到该公司指定的修理厂修车，但修理厂却不会修奔驰车。奔驰车主只好将车提至4S店维修，维修费7万元。保险公司认为根据当时定损公司最多承担三四千元维修费。物价局价格认证中心鉴定确认维修价格是5万元，可保险公司坚持只赔几千元。无奈奔驰车主只好找肇事车主，反复争论却始终没结果，于是诉诸法庭。

    法院认为，汽车交易市场对于发生过交通事故的车辆估价比无事故车辆低。在法律上，这一价值差额应是车辆直接损失，属民法损失范畴，受害人权益应得到保护。因此，法院一审判决被告肇事车主赔偿原告车辆贬值损失及评估费用199100元，保险公司赔偿汽车维修费51305元。

    一审宣判后，肇事车主和保险公司均不服，上诉至市中院。据一法官介绍，车辆贬值损失纠纷在法律上还没有相关赔偿规定。但民法中的赔偿实际上是具有填补损害的功能，无法恢复的则应对相关损失依法给予折价赔偿补偿。但被撞车辆损坏到何种程度才算贬值，具体贬值多少，目前没明确标准，是实际操作中的难题。
