外资再保险关联交易不得首席承保

    日前，记者在保监会下发给美亚财险的关于该公司和关联企业再保险交易的回复中了解到，保监会同意美亚财险和美国国际集团下属的欧洲公司以及英国公司间的再保险业务往来，但是不允许这两家公司做为合约再保险业务的首席接受人。

    据了解，自去年1月1日起，保监会就下发通知要求，外资保险公司与其关联企业之间安排合约分保的，应报告询价过程以及对手的报价情况；选择关联企业的原因；合约的主要条件，包括涉及的险种、再保险方式；比例分保的手续费及其支付方式、纯益手续费的计算方法及其支付方式等。尤其对于再保险业务的关联交易，关联方不能是合约的首席再保人；关联方在合约中所占份额不超过50%，对于多层非比例合约，关联方在每一层中所占份额不超过50%。

    税收专家表示，由于再保险业务的特殊性，外资产险公司、寿险合资公司可以通过与自己在海外的母公司之间的保险和再保险业务，将国内获得的利润转移过去，同时，外资公司与关联企业的再保险交易，使风险仍然存在于一个大主体内，容易导致严重后果。
