国债作为遗产继承要公证后才支取

    刘女士：三年前，我母亲以她自己名义购买了2万元国债。上个月母亲因病去世了，如今国债已到期，父亲拿国债单去取钱。银行工作人员表示，必须有我母亲遗产的公证书才可取，请问是这样吗？

    ■律师答疑

    新疆星河律师事务所王志业律师：根据我国婚姻法规定，国债事实上是你父母的共同财产。

    在你母亲去世后，首先要分割出你父亲的那一半，然后你父亲与你们几个兄弟姐妹再作为你母亲遗产的第一顺位继承人共同继承。

    若你们兄弟姐妹几个自愿放弃该项继承，也可以到公证处作放弃遗产继承的公证。

    待你们统一意见后，到公证处作个公证即可。银行工作人员将根据公证书中关于此项遗产的分配将投资国债的钱分配给你们。
