无证驾驶摩托车身亡 家属要求理赔被驳回

    张先生还没取得摩托车驾驶证就上路行驶，不料出车祸丧生。家属向保险公司提出理赔遭拒，于是将保险公司告到法院，要求支付保险金25万元。日前，黄浦区法院一审判决驳回原告诉请。 

    2005年7月，张先生买了辆轻便摩托车。

    几天后，他等不及取得驾驶证就开车上路，途中出车祸，未戴头盔的他不幸身亡。事后，张先生的家属向他生前投保的友邦保险公司申请理赔，但保险公司以该情形属保险责任免除情况为由，拒绝理赔。 

    法院认为，张先生签订的保单上写明，若无证驾驶机动车造成身故的，保险公司不负赔偿责任，因此驳回了家属的请求。
