无饮酒史投保人患酒精肝 起诉要求理赔未获支持

    记者昨天从浦东新区人民法院获悉，金某投保时隐瞒了自己5年多的饮酒史，他要求保险公司理赔的诉请未被支持。

    今年36岁的金某喜欢每天喝上两口白酒，2005年10月，金某查出自己患了“病毒性肝炎慢性、肝炎肝硬化；酒精性肝损害。”住院治疗43天后金某出院，前后共计花费了3万余元医疗费。

    2006年1月23日，金某向保险公司申请理赔。保险公司核保时发现，金某入院病历上写着“有饮酒史5年，日均饮白酒250ml”。保险公司表示，金某投保时有所隐瞒，自称“无饮酒史”。“我们如果在他投保时知道这一情况，肯定会拒保。”

    4月25日，保险公司以金某投保时未如实告知为由，通知金某解除保险合同，退还保费，并对金某的理赔申请不予赔付。

    金某不服，上诉至法院，称保单上饮酒情况的选择是保险代理人所为，自己对于长海医院病历记载的饮酒情况有所夸张，要求保险公司照赔。

    法院认为，订立保险合同，投保人应当如实告知，金某在保单上签字确认时应将饮酒情况的错误填写予以纠正，故法院认定金某的行为应认定为没有履行如实告知义务，法院最后没有支持金某的诉求。
