应给临时工买失业保险

    綦江县古南镇后山坡47栋1-3池加容：1986年，我的丈夫成为綦江县政府驻渝办事处的一名临时工，但一直未签聘用合同。2003年，单位才与他签订为期十年的聘用合同。今年4月，该办事处撤销。工作期间，单位一直未给他购买失业保险。请问：单位是否应该为临时工购买失业保险？    

    主持律师周永强：根据《重庆市失业保险条例》，重庆市行政区域内的国家机关中事业编制人员、劳动合同制工人和其他工勤人员(依照和参照公务员管理的人员除外)，必须依照规定缴纳失业保险费，参加失业保险。国家机关按照本单位劳动合同制工人和其他工勤人员工资总额的2%缴纳失业保险费，其劳动合同制工人和其他工勤人员按照本人工资的1%缴纳失业保险费，农民合同工不缴纳失业保险费。单位没有按时足额缴纳和代扣、代缴失业保险费，由地方税务机关责令其限期缴纳，从欠缴之日起，按日加收欠缴额2%。的滞纳金。
