工地上被钢筋伤颈农民工该如何理赔

    在工地上干活时，不小心被钢筋扎伤脖子，虽然老板出了住院费，但是出院后老板就不管了。昨日，汉口的胡先生打电话来帮老乡咨询法律问题。

    胡先生说，他和老乡王某在汉口一工地干活，25天前，王某搬运钢筋时滑了一下，被后面的人抬着的钢筋扎在了脖子上，住院花了七八千元钱，老板都付了，但却说出院后就不管了。“这受的是工伤，现在干不了活了，生活怎么办？想向公众服务网的律师咨询一下，我们该怎么办？”

    昨日，本报公众服务单位、湖北博观律师事务所田嘉律师说，职工因工作遭受事故伤害或者患职业病进行治疗，享受工伤医疗待遇。需要暂停工作接受工伤医疗的，在停工留薪期内，原工资福利待遇不变，由所在单位按月支付。停工留薪期一般不超过12个月，经设区的市级劳动能力鉴定委员会确认的可适当延长。生活不能自理的工伤职工，在停工留薪期需要护理的，由所在单位负责。

    所以，王某应及时做工伤认定，然后再根据工伤认定的结果向老板要求赔偿。
