学校不给老师办社保最高罚１万

    “近段时间，成都市部分中小学的教职员工反映学校没有与他们签订劳动合同、足额缴纳社保。”成都市劳动保障监察总队负责人透露，为维护中小学教师的合法权益，市劳动保障监察总队将从今日至5月19日对五城区(含高新区)中小学校的用工情况进行专项检查。主要检查学校是否与老师等教职员工签订劳动合同、办社保、支付工资和教师持证上岗情况。如发现学校未给老师等教职员工办理社保的，将处以1000~5000元罚款，情节严重的处以5000~10000元罚款；学校与老师等教职员工没有签订劳动合同的，按规定给予3000~30000元罚款；学校老师存在没持证上岗或持假证上岗的，将责令学校要求老师取得教师资格证后方能上岗，拒不改正的，将处以10000元以下的罚款。
