保监会颁布听证办法草案

    昨日，中国保监会颁布了《中国保险监督管理委员会行政许可听证办法(草案)》并向社会公开征求意见。根据该草案，法规规定应当听证的事项及保监会认为需要听证的其他涉及公共利益的重大保险行政许可事项，应当向社会公告，并举行听证。

    该草案规定，听证代表人应当自收到听证通知之日起5日内确认能否如期参加听证，确认参加听证的听证代表人人数不足听证公告规定的听证代表人人数三分之二的，中国保监会应当依据公告列明的听证代表人产生办法增补听证代表人，并向社会公布听证代表人的姓名、工作单位。

    草案还规定，在涉及公共利益的保险行政许可听证过程中，保险行政许可申请人不得退出听证；在涉及特定当事人利益的保险行政许可听证中，保险行政许可申请人、利害关系人放弃听证权利的，不得就同一行政许可事项再次申请听证；对于重大、复杂的保险行政许可事项，召开一次听证会尚不足以查清事实的，中国保监会可以决定就同一许可事项再次召开听证会。
